US prosecutors advocate for leniency for former FTX executive Nishad Singh after providing significant cooperation

Published:

US prosecutors are seeking favorable consideration for former FTX executive Nishad Singh‘s cooperation in investigating the failed crypto exchange based on a court filing dated Oct. 23.

The prosecutors highlighted Singh’s remorseful approach and eagerness to assist, citing that his cooperation was instrumental in uncovering how FTX’s systems were used to misappropriate customer funds.

Singh’s Extensive Cooperation

Singh also provided detailed information on Sam Bankman-Fried‘s involvement in misuse of funds and revealed previously unknown illegal activities, including campaign finance violations and falsification of financial statements at FTX.

The authorities mentioned, “Subsequent to his guilty plea, Singh collaborated with the Government extensively to decode relevant documents.”

Implications for Singh

As a result of Singh’s cooperation, prosecutors have requested a reduced sentence under Section 5K1.1 of the US Sentencing Guidelines, which allows for leniency based on substantial assistance provided in criminal investigations.

Singh’s attorneys have petitioned for a “time served” sentence, arguing for his minimal role in FTX’s downfall and efforts to prevent fraud, ultimately benefiting FTX Japan.

Singh’s sentencing is scheduled for Oct. 30.
